The Guardian reports that California is set to pass AB453 into law. This would make the removal of a condom without consent a civil battery. For the moment it doesn’t change the criminal code but could this be the leading edge? If something is a civil battery how long before there is enough impetus to make it criminal offense as well?
It is clear this will new law will open areas of new case law as society seeks to establish a boundary.
